These terms govern the relationship between Ciel Privé and any person or entity who engages it to arrange private aviation. They should be read alongside the written Client Services Agreement provided before any booking proceeds. Where the Client Services Agreement and these terms differ, the Client Services Agreement prevails. By submitting an enquiry or instructing Ciel Privé to arrange travel, you acknowledge these terms.
Ciel Privé is an independent private aviation advisory and brokerage operating from Sydney, Australia, under the registered business name CIEL PRIVE. We arrange private aircraft on behalf of clients. We are not an air operator. We do not own, operate, crew, or maintain aircraft, and we do not hold an air operator's certificate.
Our role is to act as an intermediary between the client and the aircraft operator. We identify suitable aircraft, verify the operator against recognised safety standards, present quotations, and coordinate the arrangement on the client's behalf. The contract of carriage — the contract under which the flight is actually performed — is between the client and the operator. The operator alone is responsible for the operation of the aircraft, the conduct of the crew, and the safe performance of the flight.
Quotations are prepared on the basis of the information provided by the client and the availability and pricing offered by the operator at the time of enquiry. Until a booking is confirmed in writing and payment is received, a quotation is an indication only and does not constitute a guarantee of availability or price. Aircraft availability in private aviation changes quickly, and a quoted aircraft may be unavailable by the time a client elects to proceed.
A booking is confirmed only when Ciel Privé has issued written confirmation and the client has paid in full in accordance with these terms and the Client Services Agreement. No booking is held, and no obligation to the client arises, on the basis of a quotation or verbal indication alone.
Payment is required in full before travel. Ciel Privé does not operate on deposit terms and does not hold aircraft on a partial payment. Payment is made by bank transfer, including international transfer by SWIFT or by Wise, to the account nominated by Ciel Privé in writing. We do not accept credit or debit card payment. The client is responsible for any bank charges, intermediary fees, or currency conversion costs associated with the transfer, and the amount received by Ciel Privé must be the full quoted amount net of such charges.
The price quoted for an arrangement is inclusive of the operator's charge for the flight and Ciel Privé's advisory fee unless stated otherwise. Certain costs — including but not limited to de-icing, additional ground handling, extended waiting time, catering changes, in-flight requests, and costs arising from changes instructed by the client — may fall outside the quoted price and are payable by the client. Where such costs are known in advance they will be set out in the quotation.
Changes to a confirmed booking are subject to the operator's agreement and may incur additional cost. Cancellation terms follow the cancellation policy of the operator for the specific aircraft and arrangement, and these terms are set out in the Client Services Agreement for each booking. Because cancellation charges in private aviation can be substantial and can in some cases equal the full price of the flight, clients should review the applicable cancellation terms before confirming.
The client is responsible for providing accurate and complete information for all passengers, including the identification and documentation required for the route. The client is responsible for ensuring that every passenger holds valid travel documentation and meets the entry, visa, and health requirements of every jurisdiction on the itinerary. Ciel Privé is not responsible for any consequence arising from incomplete or inaccurate passenger information or from a passenger's failure to meet documentation or entry requirements.
The operation of every flight is the sole responsibility of the operator. Ciel Privé arranges the flight; it does not perform it. To the maximum extent permitted by law, Ciel Privé is not liable for any loss, damage, injury, delay, cancellation, diversion, or other consequence arising from the operation of a flight or the act or omission of an operator, crew member, handling agent, or other third party. Where Ciel Privé is found to be liable to the client for any matter arising from its own service, its liability is limited to the amount of the advisory fee earned on the arrangement in question. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the Australian Consumer Law or other applicable law.
Ciel Privé sources aircraft only from operators that meet recognised international safety standards, as described on our Safety page. While we apply this standard with care, our verification relies on the certifications, audits, and representations of independent bodies and the operators themselves, and it does not constitute a warranty by Ciel Privé as to the safety of any flight, which remains the responsibility of the operator.
Neither Ciel Privé nor the operator is responsible for failure or delay in performance caused by events beyond reasonable control, including weather, air traffic control restrictions, airport or airspace closure, mechanical failure, strike, act of government, or other circumstance that cannot reasonably be foreseen or prevented.
Ciel Privé treats the identity, travel arrangements, and affairs of its clients as confidential, and discloses client information only as necessary to arrange travel or as required by law, consistent with our Privacy Policy.
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that state.
Ciel Privé may amend these terms from time to time. The version published on this website is the current one. The terms applicable to any particular booking are those in force, together with the Client Services Agreement, at the time the booking is confirmed.
